McCleary v. State: School Funding, New Powers of Wn. Supreme Court?

The Supreme Court had its show cause hearing yesterday in the McCleary v. State K-12 School Funding case.   The argument was televised on TVW.  It can be watched again on TVW at this link.  It is worth watching – hearing, especially the beginning.

Chief Justice Madsen made an opening statement.  The statement seems ominous because she speaks of the authority of the court as I have never heard it spoken of before.  One must be concerned about the extent the court seems ready to take onto itself something beyond the judicial power of the state as set forth in Wash. Const. Art. IV, Section 1.

It seems to me the court has itself “boxed in” as to the action it might take in holding the state in contempt.
